Terms of Service

You must be at least 18 years old and legally able to enter into a binding contract. If you are using the Service on behalf of a business, you represent that you have authority to bind that business to these Terms.

The Service is delivered through Shopify. You are responsible for:

• Maintaining the security of your Shopify store
• Ensuring you have the right to upload and use the product catalog images you connect to Vircab
• Compliance with Shopify's own Terms of Service

• Vircab offers a 7-day free trial. After the trial, you must select a paid plan or the Service stops rendering try-ons
• All billing is handled through Shopify Billing. Prices are listed in USD and exclude any applicable taxes
• Subscriptions auto-renew monthly or annually based on your selection. You can cancel at any time from your Shopify admin; cancellation is effective at the end of the current billing period
• Annual plans receive a 20% discount compared to the equivalent monthly plan. Refunds are governed by Shopify's refund policy
• We may change pricing with at least 30 days' notice; your current plan remains at the prior price until renewal

You agree not to:

• Reverse engineer, decompile, or attempt to extract source code
• Use the Service to upload content that is illegal, infringing, hateful, or sexually exploitative of minors
• Run automated try-ons that exceed your plan's monthly quota or are designed to evade rate limits
• Resell, sublicense, or white-label the Service without a separate agreement
• Probe, scan, or test the security of our infrastructure without prior written authorization

We reserve the right to suspend or terminate accounts that violate this section.

Each plan includes a fixed number of try-on renders per month (Bronze: 100, Silver: 250, Gold: 600, Platinum: 1300). Unused quota does not roll over. Once you exceed your plan's quota, new renders will be paused until the next billing cycle or until you upgrade. Custom enterprise plans are available — contact info@vircab.com.

When end customers of your store upload photos through the Vircab widget, you (the merchant) remain the data controller of that data. Vircab acts as a data processor and handles photos in accordance with our Privacy Policy. You are responsible for displaying a privacy notice to your customers consistent with applicable law.

• Vircab and arkhe retain all rights, title, and interest in the Service, including the software, AI models, infrastructure, trademarks, and documentation
• You retain ownership of your product images, store data, and customer-uploaded content
• You grant us a limited license to process this content as necessary to operate the Service

We aim for 99.9% uptime but do not guarantee uninterrupted access. Scheduled maintenance is announced in advance where possible. Production incidents are tracked and reported on request.

The Service is provided "AS IS" and "AS AVAILABLE" without warranties of any kind, express or implied, to the maximum extent permitted by law. AI-generated try-on results are best-effort visualizations and may not perfectly represent the physical product. Vircab does not guarantee that try-on results will increase sales, reduce returns, or achieve any specific business outcome.

To the maximum extent permitted by law, Vircab's total liability for any claim arising out of or related to the Service is limited to the greater of (a) the fees you paid us in the 12 months before the event giving rise to the claim, or (b) USD 100. We are not liable for indirect, incidental, special, consequential, or punitive damages, including lost profits or lost data, even if advised of the possibility.

You agree to indemnify and hold harmless Vircab and arkhe against any claim, loss, or expense arising from (a) your breach of these Terms, (b) misuse of the Service, or (c) infringement of third-party rights by content you upload or connect to Vircab.

You may stop using the Service at any time by uninstalling the app from your Shopify store. We may suspend or terminate your access if you violate these Terms or cause harm to other users. On termination, customer photo data tied to your store is removed within 48 hours via Shopify's shop redact webhook.

These Terms are governed by the laws of Türkiye, without regard to conflict of law rules. Any dispute that cannot be resolved informally shall be submitted to the courts of Istanbul Çağlayan (Istanbul Çağlayan Mahkemeleri ve İcra Daireleri).

Nothing in this section limits the mandatory rights you may have as a consumer under your local law.

We may update these Terms. Material changes will be announced via the app dashboard or email at least 14 days before taking effect. Continued use of the Service after the effective date constitutes acceptance of the updated Terms.
